These Terms and Conditions govern your use of the MyPointOfSale software platform and website operated by HixCode ("we", "us", or "our"). By accessing or using our services, you agree to these terms. If you do not agree, please do not use the service.
1. Use of the Service
MyPointOfSale is a cloud-based point-of-sale, billing, and inventory management software intended for use by retail business owners and their authorised staff. You agree to use the service only for lawful business purposes and in accordance with these terms.
You must not use the service to process fraudulent transactions, store illegal information, or in any manner that violates applicable Pakistani or international law.
2. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials. You are fully responsible for all activities that occur under your account. Notify us immediately if you suspect any unauthorised access to your account.
You must not share your account credentials with parties outside your own business. Each business should maintain its own account.
3. Data and Privacy
We collect and process data as described in our Privacy Policy. By using the service, you consent to the collection and processing of your data as described therein.
You retain ownership of your business data (products, sales records, customer information) stored in the system. We do not sell or share your business data with third parties except as required by law.
4. Service Availability
We aim to maintain high service availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. The offline billing mode is provided to minimise the impact of connectivity issues.
We are not liable for any losses resulting from service downtime, data synchronisation delays, or internet connectivity issues outside our control.
5. Intellectual Property
All intellectual property in the MyPointOfSale platform — including code, design, trademarks, and content — is owned by HixCode. You may not copy, modify, distribute, or reverse-engineer any part of the service.
6. Limitation of Liability
To the maximum extent permitted by law, HixCode and its team members are not liable for indirect, incidental, or consequential damages arising from your use of the service, including loss of business, revenue, or data.
Our total liability for any claim related to the service is limited to the amount you paid for the service in the three months preceding the claim.
7. Termination
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or are subject to a valid legal order. You may terminate your account at any time by contacting our support team.
8. Changes to These Terms
We may update these terms periodically. Continued use of the service after changes constitutes acceptance of the updated terms. We will notify active customers of significant changes via email or in-app notification.
9. Governing Law
These terms are governed by the laws of Pakistan. Any disputes shall be resolved through the appropriate legal channels in Pakistan.
